Legal
Terms & Conditions
These Terms govern your access to Sitework Pro Estimating, provided by Sitework Pro-Estimating LLC. By creating an account, purchasing a plan, or continuing to use the service, you agree to these Terms.
Effective date: October 5, 2026
1. The service
Sitework Pro Estimating provides construction plan takeoff, estimating, cost-library, proposal, review, reporting and related collaboration tools. Features and usage limits depend on the plan selected.
You receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during your subscription. You do not acquire ownership of the service or its software.
2. Accounts and authority
You must be legally able to enter a contract and, when acting for a company, authorized to bind it. You must provide accurate information, keep it current, protect account credentials, and promptly report suspected unauthorized access. You are responsible for activity under your account and for authorized team members.
3. Payments, subscriptions and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, renewals, cancellations and refund mechanics are governed by the applicable checkout disclosures and Paddle Buyer Terms. Subscription charges recur at the interval shown at checkout until canceled. If you cancel, access continues through the paid billing period unless Paddle states otherwise. Plan changes may take effect immediately as shown at checkout.
4. Estimating and AI responsibilities
The service assists professional judgment; it does not replace it. Takeoff quantities, prices, assemblies, code notes, comparisons, reports and AI-generated results may be incomplete or inaccurate. You must review plan sheets, addenda, measurements, scope, quantities, costs, code requirements and proposal terms before relying on or submitting them.
You are responsible for your prompts, uploaded plans and other inputs, your right to use them, and how you use outputs. Do not use outputs as legal, engineering, architectural, surveying, safety, tax or other regulated professional advice without review by a qualified professional.
You retain your rights in content you submit. You grant us a limited license to host, process, reproduce and transmit that content only as needed to operate, secure and improve the service. Subject to applicable law and third-party rights, you may use outputs generated for you.
5. Acceptable use
You must not use the service for unlawful, fraudulent, deceptive or harmful activity; spam; infringement; harassment or hate; impersonation or deceptive synthetic media; malware; security probing; credential theft; unauthorized scraping; jailbreaking or circumvention of safeguards; reverse engineering; resale or redistribution; or attempts to exceed technical or plan limits.
We may filter or refuse requests, restrict or remove content, investigate abuse, and suspend or terminate access for material breach, non-payment, security or fraud risk, repeated infringement, or serious or repeated policy violations. Rights holders may report suspected infringement to estimate@siteworkpro-estimating.com. We may remove challenged content and terminate repeat infringers where appropriate.
6. Ownership and feedback
Sitework Pro-Estimating LLC and its licensors own the service, software, documentation, branding and related intellectual property. You may not remove notices, copy protected elements, create derivative services, or use our marks without permission. If you provide feedback, we may use it without restriction or compensation.
7. Availability and changes
We work to keep the service available, but do not guarantee uninterrupted, secure or error-free operation. We may maintain, change, suspend or discontinue features. Events outside our reasonable control may affect availability. We may update these Terms and will post the revised effective date; continued use after an update constitutes acceptance where permitted by law.
8. Disclaimers and liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We are not responsible for bid losses, pricing errors, missed scope, inaccurate AI output, third-party services, or decisions made from service results.
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, data, goodwill or opportunities. Our aggregate liability arising from the service will not exceed the fees you paid for the service during the 12 months before the event giving rise to the claim. These limits do not exclude liability that cannot legally be limited, including fraud or liability for death or personal injury caused by negligence where applicable.
9. Termination and data
You may stop using the service or cancel through the billing portal. When access ends, your right to use the service ends. We may delete or anonymize account data after applicable retention periods, subject to legal obligations and reasonable backup cycles. Export important records before access ends.
10. Governing law and contact
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Courts with jurisdiction in Kentucky will have exclusive venue, except where consumer law requires otherwise. If a provision is unenforceable, the rest remains effective. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, financing or sale of assets.
